1. The agreement
These Terms of Use are an agreement between you and Foggo Apps (Charles Chiejina, "we", "us") for Phyziq on iPhone and Apple Watch. Your licence to use the app is granted under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms add the details specific to Phyziq; if the two conflict, the Standard EULA applies. By downloading or using Phyziq you agree to these Terms and the Standard EULA. Our Privacy Policy explains how data is handled.
2. What Phyziq is
Phyziq helps you log workouts, build routines and programs, record measurements and progress photos, and follow your character's progress. Optional Apple Health access provides fitness information and lets you save workouts. The Apple Watch companion exchanges the live session with your phone.
Health data, sensor readings, calories and other fitness calculations may differ from other apps or devices. Some features depend on the permissions you grant and your device's capabilities.
3. Health and safety
- Phyziq is for general fitness. It is not a medical device and does not diagnose, treat or prevent any condition. Training suggestions and fitness estimates are not medical advice.
- Choose exercises, weights and intensity appropriate to you. Seek qualified advice before starting a new routine if you have a health condition or are unsure what is safe. Stop exercising if you feel unwell or experience pain.
- Check imported and generated routines before using them. Stay aware of your surroundings and use equipment safely.
4. Gym Pass subscriptions
Gym Pass is available as a monthly or yearly auto-renewable subscription, or as a Lifetime purchase. Access can also be provided to recognised Founding members. The app shows the price, billing period, eligibility and any offer before you buy; the purchase screen is the source for your local price.
- Free days and trial: everyone gets 7 free days from their first day in Phyziq. On the first day only, Gym Pass Basic (monthly) and Gold Gym Pass (yearly) can be bought with Apple's one-week free trial, which covers the same week; later they have no trial. Unless you cancel at least 24 hours before a trial ends, Apple charges the plan price shown when the trial ends. Platinum Gym Pass (Lifetime) is a one-time purchase.
- Payment: Apple charges your Apple Account when you confirm the purchase, or when an eligible free trial ends.
- Renewal: subscriptions renew automatically at the stated price and period unless cancelled at least 24 hours before the current period ends. Renewal charges may be made within the final 24 hours. Apple handles notices and any required consent for price changes.
- Managing or cancelling: use iPhone Settings → [your name] → Subscriptions, or manage subscriptions with Apple. Cancelling stops future renewal; paid access continues for the remaining paid period. Deleting Phyziq or your Foggo Apps account does not cancel a subscription.
- Offers: the price, duration and eligibility are shown in the app. A discounted subscription still renews; a discounted Lifetime purchase is still a one-time purchase.
5. Lifetime purchase
Lifetime is a one-time, non-consumable purchase that unlocks Gym Pass for as long as Phyziq is offered on the App Store, on devices using the same Apple Account. It does not renew. You can restore it through Restore purchases. Buying Lifetime does not automatically cancel an existing subscription; cancel that separately through Apple to avoid further charges.
6. Restores and refunds
Use Restore purchases on the Gym Pass screen or in Settings → Account & Gym Pass, with the Apple Account used to buy it. A Foggo Apps sign-in is not required. Restoring purchases restores access, not your workout files.
Apple processes purchases and refund requests. To request a refund, visit reportaproblem.apple.com and follow Apple's refund steps. Eligibility is decided by Apple under its policies. This does not affect your statutory consumer rights. If a purchase is not recognised in Phyziq, email us.
7. Accounts and your data
An account is optional. Apple and Google sign-in, and email codes when enabled, use the shared Foggo Apps account system. Your workouts, routines, measurements, photos and character are stored locally; signing in does not create a cloud backup or sync those files to a new phone. Keep your own backups.
You can delete your Phyziq account in Settings or by email. Deletion cannot be undone. It leaves your device's workout data, Apple subscriptions and any Step Tomo account intact. The underlying shared sign-in identity remains while another app still uses it.
8. AI features
AI can help read workout plans, interpret dictated text, generate plans and suggest exercise matches or muscle labels. Suggestions can be inaccurate, incomplete or unsuitable for you. Review exercises, sets, repetitions, timing and any modifications before training. Do not rely on AI for diagnosis or treatment.
AI currently uses Apple Intelligence on eligible iPhones; availability depends on device and system support. Gemini cloud fallback is currently disabled. The Privacy Policy explains what would be sent through our proxy if cloud fallback is offered. Only submit material you have permission to use.
9. Character and rewards
Your character, levels, gear, tokens and other rewards are part of the app. They have no cash value, cannot be cashed out, and are licensed to you rather than owned. We may adjust progression and rewards as the app develops. Locally stored progress may be lost if you remove the app without a usable backup.
10. Acceptable use
Please don't copy, modify, reverse engineer or resell the app except where the law allows it; misuse another person's account; exploit bugs or tamper with purchases and rewards; or interfere with services connected to Phyziq. Do not use the app or its AI features for unlawful content or to infringe another person's rights. We may limit online access for misuse.
11. Intellectual property
Phyziq's artwork, characters, animation, sounds, text and code belong to Foggo Apps or its licensors. Using the app gives you no ownership of them. You are welcome to share screenshots and short recordings of your own use for personal, non-commercial purposes. If you send us ideas or feedback, we may use them without obligation to you.
12. Changes to the app
Features and content may be added, changed or retired. We will try to give notice of significant changes to paid features. Some features depend on Apple Health, Apple Watch, Apple Intelligence or other services and system versions. See the App Store for current compatibility requirements.
13. Disclaimers
To the extent the law allows, Phyziq is provided "as is" and "as available", without warranties of uninterrupted or error-free operation, recovery of local data, or accuracy of fitness information and AI suggestions. Some jurisdictions do not allow certain warranties to be excluded, so some of this may not apply to you.
14. Limitation of liability
To the extent the law allows, Foggo Apps will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of data or progress, arising from your use of Phyziq. Our total liability for a claim relating to the app is limited to the amount you paid for it in the preceding 12 months, subject to the Standard EULA. Nothing limits liability that cannot be limited by law, including death or personal injury caused by negligence, or your statutory consumer rights.
15. Apple
These Terms are between you and Foggo Apps, not Apple. Apple is not responsible for Phyziq or its content, has no obligation to provide maintenance or support, and is not responsible for product liability, legal compliance or intellectual property claims about it. If the app fails to conform to an applicable warranty, you may notify Apple for a refund of the app's purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms. You confirm that you are not in a country subject to a US Government embargo or on a US Government list of prohibited or restricted parties.
16. Changes and contact
We may update these Terms. We will post the new version here with a new effective date and tell you in the app about material changes. Continued use after a change takes effect means the updated Terms apply. If you disagree, stop using Phyziq and cancel any subscription.
